IWN Session on Prevention of Sexual Harassment Act at Workplace

·         Indian Women Network (IWN) – CII organised a session on Prevention of Sexual Harassment (POSH) Act at Workplace. The day-long session provided a legal overview from on employer’s perspective and discussed the Prohibitions and Redressal of the Act 2013. Sexual harassment at the workplace is a violation of the constitutionally guaranteed fundamental right of a woman to equality, to life, and to practice any profession or trade – which includes the right to a safe environment free from sexual harassment.

·     This interactive session was planned to help organizations understand their roles and responsibilities with the advent of the new statute. It will help employers audit their practices and ensure compliance. 

·        Vanitha Datla, Chairwoman IWNAP, Vice Chairperson CII AP inaugurating the session said, “Indian Women Network being an exclusive platform for career women – employees, professionals and entrepreneurs to network, learn, share and seek better opportunities. Through the session the IWN aims to create awareness among all the participants”. 

·       Introducing the sexual harassment laws, Ms Purnima Kamble, Partner, Foxmandal & Associates, said, “The Sexual Harassment of Women at Workplace (Prevention, Prohibition & Redressal) Act, 2013 makes it mandatory for employers not only to prevent and prohibit workplace sexual harassment, but also to provide employees with an impartial grievance redressal mechanism.  Exercising reasonable care enables you to reduce your liability as an employer and ensure that your work environment is free from sexual harassment.” She also emphasised on the role of Internal Complaints Committee (ICC) and on the Vishakha guidelines. 

·     Dr. Lakshmi Lingam, Convenor, Policy & Services IWN AP & Deputy Director, Tata Institute of Social Sciences, Hyderabad said that the Act should not act as a deterrent but as an enabler.

·      The session covered the backdrop in which the act was enacted; knowledge on basic features of the Act and Rules and the various components of complaints, procedures and repercussions of sexual harassment.

 
Description

Against this background CII- Indian Women Network (IWN)-AP organised as session on Prevention of Sexual Harassment Act at Workplace, (Prohibitions & Redressal) Act 2013 – Legal Overview on Employers perspective on 20th March 2014 at Hyderabad. 

The objective of the interactive was to help organizations understand their roles and responsibilities with the advent of the new statute and help employers audit their practices and ensure compliance.

 

The Workshop covered the following

·         Backdrop in which the act was enacted.

·         Knowledge on basic features of the Act and Rules.

·         Mode and Manner of Complaint.

·         Mode and Manner of dealing with Cases/Complaints of Sexual Harassment (Procedure of Inquiry).

·         Knowledge on various committees as per the act (Composition, Qualification of members, procedure of Function, remuneration etc.)

·         Guideline on Internal Policy formation on Prevention, Prohibition & Redressal of Sexual Harassment.

·         Punishments as per the Act.

·         Penalties on organizations for Non Compliances of the Act.

·         Knowledge on organizing Orientation Program for Internal Complaints Committee Members and for other staff members.

·         Mode and Manner of Annual Return Filling under sexual Harassment ( Prevention, Prohibition & Redressal) Act, 2013

·         Suggestions of creating Safe & Secure Workplace.

·         Rights of Complainant & Rights of Accused.

·         Safeguards against false or malicious charges.
